Terms Of Service
"Physivert Solutions" means the company physivert solutions pvt. ltd. registered in india having its registered office at E-92, Phase-7, Industrial Area, Mohali-160055
Terms of Service applicable on Web Hosting, Domain Registration End clients and Reseller
1) The Support available for the Web Hosting clients is limited to helping them in using the control panel, helping them upload there sites, it will in no case will include helping them to change the code of their programs if there is any runtime error.
2) Support provided to Web Hosting clients will not include anything except helping them upload their websites, helping them use the control panel provided to them with the web hosting account. Helping them access their control panel if they loose their password.
3) Support provided to Domain Registration clients will not include anything except helping them upload their websites, helping them use the control panel provided to them with the Domain Registration account. Helping them access their control panel if they loose their password.
4) Support provided to reseller clients will not include anything except helping them upload their websites, helping them use the control panel provided to them with the reseller account. Helping them access their control panel if they loose their password.
5) Physivert Solutions don't take any responsibility of data being stored on our servers if gets lost or erased accidently or through hacking or any other way, we recommend that clients using our services should backup their data, regularly.
6) If Any client is found to be doing any illegal activity and law enforcing authorities ask for the information stored on our servers or the contact information of the client, Physivert Solutions will handover the data that will help them solve the problem without notifying the client.
7) Client will be responsible for the type of material being hosted by him, and if found illegal by law and any complaints are made against it, Physivert Solutions hold the right to terminate clients account or give him a warning and ask him to remove the content.
8) Physivert Solutions holds the right to terminate or suspend any Hosting account at any time without giving any reason to the client.
9) In any case if any type penalty arises the amount to be paid by Physivert Solutions shall never be more than the amount paid by the same client for buying that service or product on which it arose.
10) Client will be doing dealing with people through Physivert Solutions service at his own risk, Physivert Solutions are not responsible for any liabilities arise on part of client from anybody due to any thing wrong with our service.
11) Spamming, IRc bots, hosting any type of servers or hosting of adult or illegal is strictly prohibited on our servers, anyone found indulged in doing such acts will have his/her/their account terminated immediately and handed over to legal authorities if required.
12) Physivert Solutions May update the Terms Of service Without giving any notice to the client at any time and that terms will also be applicable to the client.
13)If a client requests Physivert Solutions to install any software on their servers for the client to utilise the final decision to install or not to install will totally be taken by Physivert Solutions and will be Binding on the client
14) If there is overuage of the bandwidth or disk then the accounts will be suspended and whenever the account will be reactivated the client or reseller that is overusing the rseources have to the pay for the extra resources that they have used as they are responsible for maintianing the usage for the package under allocated.
15)We will not tolerate if any client abusing the disk usage. At least 90% of your hosting disk/web space usage must be webpages (html, php, asp, aspx etc) must be “Linked” with the main page, accounts not following the terms will be terminated or suspended without giving any prior notice
16)Web sites those are found containing no html documents or a large number of unlinked files are subjected to deletion of files or account cancellation with or without prior notice.
17)Physivert Solutions has the right to change the cost price or selling price of its products and services at any time without giving any notice to any of the affected resellers or customers.

18) There are No policy for issuing refunds unless explicitly specified for a particular package.

19) Any increase required in diskspace or bandwidth by a client who has paid for multiple years in advance will lead to cancellation of the remaining term at the time of increase .

20) We don't offer Phone support we only offer 24 hours ticket based support.

21) Any disputes arising will be subject to jurisdiction of Courts authorized to handle at Mohali Punjab India

22) User Doing any of the following will get his account suspended/deleted immidiately
a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
b) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
c) Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
d) Run any software that interfaces with an IRC (Internet Relay Chat) network.
e) Run any bit torrent application, tracker, or client. Please note that you may link to torrents off server, but may not host or store them.
f) Participate in any file-sharing/peer-to-peer activities
g) Run any gaming servers such as counter-strike, half-life, battlefield1942, etc
h) Run cron entries with intervals of less than 15 minutes

23) Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized
copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account.
Examples of unacceptable material on all Shared, Reseller and Dedicated Servers include:
IRC Bots, Proxy Scripts / Anonymizers, Pirated Software / Warez, image, filedump, or banner-ad services (similar to rapidshare, photobucket, or commercial banner ad rotation), topsites, commercial audio streaming (more than one or two streams), Escrow, High-Yield Interest Programs(HYIP) or related sites, Investment sites (FOREX, egold exchange), sale of any controlled substance without prior proof of appropriate permit(s), AutoSurf sites, Bank Debentures, Bank Debenture Trading Programs, Prime Banks Programs, lottery sites, muds / rpg's, hate sites, hacker focused sites/archives/programs, or sites promoting illegal activities, IP Scanners, Brute Force Programs, Mail Bombers and Spam Scripts. Forums that distribute or link to warez content is prohibited.
24) Client Web Hosting accounts should not resell web hosting to other people in any way, if you wish to resell hosting you must use a reseller account, anybody found doing it will have their account suspended/terminated immediately.
25) Client Web Hosting accounts should not give free email ids or free web hosting accounts any body found doing it will have their account suspended/terminated immediately.
26) Physivert Solutions will not tolerate any rude behaviour with our employees from any of the account holder and will terminate/suspend the offending accounts.
27) Physivert Solutions tries its best to keep the servers online and accessible all over the internet, but if the servers becomes unaccessible due to any reason we shall not liable for anything.
28) Client should keep a check on the terms of service as frequently as he/she/they can because if the client keeps on using the service after a change has been made to Terms of Service then that means the client agrees to the terms of service.
